{"data":{"id":"us-ut/utah-code-19-1-105","jurisdiction":"us-ut","citation":"Utah Code § 19-1-105","heading":"Divisions of department -- Control by division directors.","body":"(1) The following divisions are created within the department:\n(a) the Division of Air Quality, to administer:\n(i) Chapter 2, Air Conservation Act; and\n(ii) Chapter 2a, Air Quality - Special Provisions;\n(b) the Division of Drinking Water, to administer Chapter 4, Safe Drinking Water Act;\n(c) the Division of Environmental Response and Remediation, to administer:\n(i) Chapter 6, Part3, Hazardous Substances Mitigation Act; and\n(ii) Chapter 6, Part4, Petroleum Storage Tank Act;\n(d) the Division of Waste Management and Radiation Control, to administer:\n(i) Chapter 3, Radiation Control Act;\n(ii) Chapter 6, Part1, Solid and Hazardous Waste Act;\n(iii) Chapter 6, Part2, Hazardous Waste Facility Siting Act;\n(iv) Chapter 6, Part5, Solid Waste Management Act;\n(v) Chapter 6, Part6, Lead Acid Battery Disposal;\n(vi) Chapter 6, Part7, Used Oil Management Act;\n(vii) Chapter 6, Part8, Waste Tire Recycling Act;\n(viii) Chapter 6, Part11, Industrial Byproduct Reuse;\n(ix) Chapter 6, Part12, Disposal of Electronic Waste Program; and\n(x) Chapter 6, Part13, Testing and Disposal of Solar Panel Waste; and\n(e) the Division of Water Quality, to administer Chapter 5, Water Quality Act.\n(2) Each division is under the immediate direction and control of a division director appointed by the executive director.\n(3)\n(a) A division director shall possess the administrative skills and training necessary to perform the duties of division director.\n(b) A division director shall hold one of the following degrees from an accredited college or university:\n(i) a four-year degree in physical or biological science or engineering;\n(ii) a related degree; or\n(iii) a degree in law.\n(4) The executive director may remove a division director at will.\n(5) A division director shall serve as the executive secretary to the policymaking board, created in Section 19-1-106, that has rulemaking authority over the division director's division.","path":["Title 19 Environmental Quality Code","Chapter 19-1 General Provisions","Part 19-1-1 Organization"],"source_url":"https://le.utah.gov/xcode/Title19/Chapter1/19-1-S105.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"396cd35fe2b1f049a8e1acbe4a1109fb9630f0a461199a18d7549d379a0136a5","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-19-1-104","next":"us-ut/utah-code-19-1-106"},"notice":"GroundRules: Original legal text.
