{"data":{"id":"us-ut/utah-code-19-12-305","jurisdiction":"us-ut","citation":"Utah Code § 19-12-305","heading":"Rulemaking authority.","body":"(1) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, for purposes of a certification related to air pollution, other than air pollution related to property described in Subsection (3), the Air Quality Board may make rules establishing procedures for:\n(a) processing and evaluating an application for certification; and\n(b) the issuance and revocation of a certification.\n(2) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, for purposes of a certification related to water pollution, other than water pollution related to property described in Subsection (3), the Water Quality Board may make rules establishing procedures for:\n(a) processing and evaluating an application for certification; and\n(b) the issuance or revocation of a certification.\n(3) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, for purposes of a certification related to property within the jurisdiction of the Board of Oil, Gas, and Mining under Section 40-6-5, the Board of Oil, Gas and Mining may make rules establishing procedures for:\n(a) processing and evaluating an application for certification; and\n(b) the issuance or revocation of a certification.","path":["Title 19 Environmental Quality Code","Chapter 19-12 Pollution Control Act","Part 19-12-3 Procedures for Certification and Revocation of Certification"],"source_url":"https://le.utah.gov/xcode/Title19/Chapter12/19-12-S305.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"aaba926a6eb2c2e7b789febb8725e52e29d3e8280def2a24fd8565ad50f8b172","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-19-12-304","next":"us-ut/utah-code-19-13-102"},"notice":"GroundRules: Original legal text.
