{"data":{"id":"us-ut/utah-code-19-13-106","jurisdiction":"us-ut","citation":"Utah Code § 19-13-106","heading":"Eligibility review.","body":"(1) The department shall:\n(a) review and evaluate an application submitted under Section 19-13-104; and\n(b) determine whether the municipality or county is eligible for designation as a recycling market development zone.\n(2) In designating recycling market development zones, the department shall consider:\n(a) whether the current waste management practices and conditions of the county or municipality are favorable to the development of postconsumer waste material markets;\n(b) whether the creation of the zone is necessary to assist in attracting private sector recycling investments to the area; and\n(c) the amount of available landfill capacity to serve the zone.","path":["Title 19 Environmental Quality Code","Chapter 19-13 Recycling Market Development Zone Act"],"source_url":"https://le.utah.gov/xcode/Title19/Chapter13/19-13-S106.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"807f3b611e179a0ffa2079b4787de5f98d4328de15e27a619b44e72e788767fd","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-19-13-105","next":"us-ut/utah-code-19-13-107"},"notice":"GroundRules: Original legal text.
