{"data":{"id":"us-ut/utah-code-19-2a-108","jurisdiction":"us-ut","citation":"Utah Code § 19-2a-108","heading":"Fugitive dust facility -- Definitions -- Signage requirement.","body":"(1) As used in this section:\n(a) \"Division\" means the Division of Air Quality created in Section 19-1-105.\n(b) \"Fugitive dust\" means particulate matter that becomes airborne from the mechanical disturbance or wind-blown disturbance of a material or surface.\n(c) \"Fugitive dust control plan\" means a plan that:\n(i) indicates the methods a fugitive dust facility uses to control and monitor fugitive dust; and\n(ii) complies with relevant state and federal law for a fugitive dust facility.\n(d)\n(i) \"Fugitive dust facility\" means a commercial facility or site:\n(A) larger than a quarter acre;\n(B) that produces fugitive dust; and\n(C) that the division requires to complete a fugitive dust control plan.\n(ii) \"Fugitive dust facility\" includes:\n(A) an aggregate operation that extracts, crushes, screens, grinds, stores, or transports rock material, including sand, gravel, stone, and other rock products;\n(B) an excavation site, including an excavation activity like trenching, grading, drilling, or earthmoving; and\n(C) a site for topsoil or bulk material handling, including stripping, loading, unloading, moving, or spreading soil, fill, or another bulk material.\n(iii) \"Fugitive dust facility\" does not include:\n(A) an agricultural or horticultural operation; and\n(B) the sanding or salting of a roadway for snow and ice control.\n(2) A fugitive dust facility shall post informational signage:\n(a) at an entryway to the fugitive dust facility that is clearly visible to the public; and\n(b) that includes the following information:\n(i) the name of the facility or site;\n(ii) a permit identification number;\n(iii) a business identification number; and\n(iv) the contact information for:\n(A) the facility manager or owner; and\n(B) the division.","path":["Title 19 Environmental Quality Code","Chapter 19-2a Air Quality - Special Provisions"],"source_url":"https://le.utah.gov/xcode/Title19/Chapter2a/19-2a-S108.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"70bca28212698072cb4c21e04f29cecb20cec441746b952a43392df8e63bf3d9","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-19-2a-107","next":"us-ut/utah-code-19-3-102"},"notice":"GroundRules: Original legal text.
