{"data":{"id":"us-ut/utah-code-20a-11-1702","jurisdiction":"us-ut","citation":"Utah Code § 20A-11-1702","heading":"Definitions.","body":"As used in this part:\n(1) \"Clearly identified\" means:\n(a) the name of the candidate appears;\n(b) a photograph or drawing of the candidate appears; or\n(c) the identity of the candidate or ballot proposition is apparent by unambiguous reference.\n(2)\n(a) \"Independent expenditure\" means an expenditure by a person expressly advocating the success or defeat of a clearly identified candidate or ballot proposition if the expenditure is not made in coordination with, or at the request or suggestion of:\n(i) a candidate;\n(ii) a candidate's personal campaign committee;\n(iii) a member of a candidate's personal campaign committee;\n(iv) a political action committee for which the candidate is an officer with primary decision making authority;\n(v) an agent of a candidate; or\n(vi) a political issues committee.\n(b) \"Independent expenditure\" includes:\n(i) the cost of creating and disseminating material for a public communication, including design and production costs; and\n(ii) a contract or other promise to make an expenditure described in Subsection (2)(a) or (2)(b)(i).\n(3)\n(a) \"Public communication\" means a communication by:\n(i) broadcast, cable, satellite communication, newspaper, magazine, outdoor advertising facility, mass mailing, or telephone bank; or\n(ii) another medium used for political advertising to the general public.\n(b) \"Public communication\" does not include:\n(i) a news story, a commentary, or an editorial disseminated by a broadcasting station, including a cable television operator, programmer, or producer, satellite television or radio provider, website, newspaper, magazine, or other periodical publication, that is not controlled by a candidate or political party; or\n(ii) a candidate debate or forum.\n(4) \"Telephone bank\" means 500 or more identical or substantially similar telephone calls within any 30-calendar-day period.","path":["Title 20A Election Code","Chapter 20A-11 Campaign and Financial Reporting Requirements","Part 20A-11-17 Independent Expenditures"],"source_url":"https://le.utah.gov/xcode/Title20A/Chapter11/20A-11-S1702.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"360f8649d4875afbb9a171de23415a8d851253229b2882f0009626b1274b3e9b","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-20a-11-1701","next":"us-ut/utah-code-20a-11-1703"},"notice":"GroundRules: Original legal text.
