{"data":{"id":"us-ut/utah-code-20a-2-605","jurisdiction":"us-ut","citation":"Utah Code § 20A-2-605","heading":"Request for voter registration records by a government official.","body":"(1) Except as otherwise provided in this section or another express provision of law, upon request by a government official acting in the government official's capacity as a government official, the lieutenant governor or a county clerk:\n(a) shall disclose to the government official only the information in a voter registration record necessary to permit the government official to fulfill an official duty imposed by law on the government official; and\n(b) may not disclose to the government official the information in a voter registration record that is not necessary to permit the government official to fulfill an official duty imposed by law on the government official.\n(2) A government official who receives information under Subsection (1)(a):\n(a) shall ensure, using industry standard security measures, that the information may not be accessed by a person other than the government official or the government entity that the government official represents;\n(b) may only use the information to the extent necessary to fulfill a duty of the government official; and\n(c) may not disclose the information to a person other than a person needing the information to fulfill a duty of the government official or the government entity that the government official represents.\n(3) Before providing the information described in Subsection (1)(a) to a government official:\n(a) the lieutenant governor or county clerk shall verify that:\n(i) the person requesting the information is a government official; and\n(ii) it is necessary to provide the information requested to permit the government official to fulfill an official duty imposed by law on the government official; and\n(b) the government official requesting the information shall sign a request form that includes:\n(i) the name, address, and telephone number of the government official;\n(ii) the government official's position or title;\n(iii) a description of the information requested;\n(iv) a description of the official duty imposed by law on the government official that requires the requested information;\n(v) a statement that the government official will ensure, using industry standard security measures, that the information may not be accessed by a person other than the government official or the government entity that the government official represents;\n(vi) a statement that the government official will only use the information to the extent necessary to fulfill an official duty imposed by law on the government official;\n(vii) an assertion that the government official will not provide or use the information obtained from the voter registration records in a manner that is prohibited by law;\n(viii) a statement that obtaining the information under false pretenses, or providing or using the information from the voter registration records in a manner that is prohibited by law, is punishable as a class A misdemeanor and a civil fine; and\n(ix) notice that if the person signing the request form makes a false statement in the request form, the person is punishable by law under Section 76-8-504.\n(4) The lieutenant governor or a county clerk may not disclose the information under this section if the lieutenant governor or county clerk reasonably believes that the person:\n(a) is not a government official;\n(b) does not need the information requested to fulfill an official duty imposed by law on the government official; or\n(c) will provide or use the information in a manner prohibited by law.","path":["Title 20A Election Code","Chapter 20A-2 Voter Registration","Part 20A-2-6 Provision And Protection Of Voter Data"],"source_url":"https://le.utah.gov/xcode/Title20A/Chapter2/20A-2-S605.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"c86795a361fce18a9de3dfabaaeaed58a4585cad7a73b42a95038ba384887576","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-20a-2-604","next":"us-ut/utah-code-20a-2-606"},"notice":"GroundRules: Original legal text.
