{"data":{"id":"us-ut/utah-code-23a-4-501","jurisdiction":"us-ut","citation":"Utah Code § 23A-4-501","heading":"Wildlife license agents.","body":"(1) The director may designate wildlife license agents to sell licenses, permits, and tags.\n(2) A wildlife license agent may:\n(a) sell a license, permit, or tag to an eligible applicant, except for a license, permit, or tag specified in Subsection 23A-4-503(2) which may be sold only by the division; and\n(b) collect a fee for a license, permit, or tag sold.\n(3) A wildlife license agent shall receive:\n(a) for a wildlife license, permit, or tag having a fee equal to $10 or less but greater than $1, 50 cents for a wildlife license, permit, or tag sold; and\n(b) for a wildlife license, permit, or tag having a fee greater than $10, 5% of the fee.\n(4) The division may require a wildlife license agent to obtain a bond in a reasonable amount.\n(5)\n(a) As directed by the division, a wildlife license agent shall:\n(i) report the wildlife license agent's sales to the division; and\n(ii) submit to the division the fees obtained from the sale of licenses, permits, and tags less the remuneration provided in Subsection (3).\n(b) If a wildlife license agent fails to pay the amount due, the division may assess a penalty of 20% of the amount due. A delinquent payment shall bear interest at the rate of 1% per month. If the amount due is not paid because of bad faith or fraud, the division shall assess a penalty of 100% of the total amount due together with interest.\n(c) Fees, except the remuneration provided in Subsection (3), shall:\n(i) be kept separate from the private money of the wildlife license agents; and\n(ii) belong to the state.\n(6) A wildlife license agent may not intentionally:\n(a) fail to date or misdate a license, permit, or tag;\n(b) issue a hunting license or permit to an individual until that individual furnishes proof of successful completion of a division-approved hunter education course as provided in Section 23A-4-1001; or\n(c) issue a furbearer license to an individual until that individual furnishes proof of successful completion of a division-approved furharvester education course as provided in Section 23A-4-1005.","path":["Title 23A Wildlife Resources Act","Chapter 23A-4 Licenses, Permits, Certificates of Registration, and Tags","Part 23A-4-5 License Agents"],"source_url":"https://le.utah.gov/xcode/Title23A/Chapter4/23A-4-S501.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"8b8443f1d8a575f8eabf107e91d7e1d095ed3c43b2bad16a65a3e677fe154e5d","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-23a-4-402","next":"us-ut/utah-code-23a-4-502"},"notice":"GroundRules: Original legal text.
