{"data":{"id":"us-ut/utah-code-23a-6-202","jurisdiction":"us-ut","citation":"Utah Code § 23A-6-202","heading":"Acquisition of real property held in private ownership -- Published notice and governor's approval required.","body":"(1) The division may not acquire title to real property held in private ownership without first:\n(a) publishing a notice of the proposed acquisition on:\n(i) the division's public website; and\n(ii) a public legal notice website in accordance with Section 45-1-101; and\n(b) obtaining the approval of the governor.\n(2) Subsection (1) applies whether title to real property held in private ownership is acquired through a purchase, donation, or other means.\n(3) In the case of a proposed purchase of private property, the division may publish notice after earnest money is paid.\n(4) The published notice shall inform the public regarding:\n(a) the proposed use of the real property;\n(b) any conditions on the acquisition of the real property placed by donors, the federal government, sellers, or others specifying how the real property is to be used;\n(c) any changes to existing land uses that are anticipated; and\n(d) the public comment submission process for comments on the proposed acquisition.\n(5) The governor shall:\n(a) submit a notification of the proposed acquisition to:\n(i) the county executive of the county in which the real property is located;\n(ii) the legislators of the legislative districts in which the real property is located; and\n(iii) the School and Institutional Trust Lands Administration; and\n(b) invite those notified to submit comments on the proposed acquisition.\n(6) After considering comments on the proposed acquisition, the governor may:\n(a) approve the acquisition in whole or in part; or\n(b) disapprove the acquisition.","path":["Title 23A Wildlife Resources Act","Chapter 23A-6 Lands and Waters for Wildlife Purposes","Part 23A-6-2 Acquisition"],"source_url":"https://le.utah.gov/xcode/Title23A/Chapter6/23A-6-S202.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"56a1ef713ca733cfe2f2ec9500617120a1c01d71d5d749275b3f9c4ab7f1b1a4","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-23a-6-201","next":"us-ut/utah-code-23a-6-203"},"notice":"GroundRules: Original legal text.
