{"data":{"id":"us-ut/utah-code-26b-2-128","jurisdiction":"us-ut","citation":"Utah Code § 26B-2-128","heading":"Numerical limit of foster children in a foster home -- Limits on bedroom sharing.","body":"(1)\n(a) No more than four foster children may reside in the foster home of a licensed foster parent.\n(b) No more than three foster children may reside in the foster home of a certified foster parent.\n(2) When placing a child into a foster home, the limits under Subsection (1) may be exceeded:\n(a) to place a child into a foster home where a sibling of the child currently resides; or\n(b) to place a child in a foster home where the child previously resided.\n(3) The limits under Subsection (1) may be exceeded for:\n(a) placement of a sibling group in a foster home with no more than one other foster child placement;\n(b) placement of a child or sibling group in a foster home where the child or sibling group previously resided; or\n(c) placement of a child in a foster home where a sibling currently resides.\n(4)\n(a) A foster child may not share a bedroom with a child of the opposite biological sex unless:\n(i) each child sharing the bedroom is under two years old;\n(ii)\n(A) the department's client record identifies gender-specific rationale for sharing the bedroom;\n(B) sharing the bedroom is in the best interests of each child sharing the bedroom; and\n(C) all children sharing the bedroom are relatives; or\n(iii)\n(A) there is written caseworker approval for the bedroom assignment;\n(B) sharing the bedroom is in the best interests of each child sharing the bedroom; and\n(C) all children sharing the bedroom are relatives.\n(b) The Division of Child and Family Services shall approve a bedroom assignment by which a child has their own bedroom if:\n(i) there is a gender-specific or sexual-orientation specific rationale for the bedroom assignment; and\n(ii) the bedroom assignment is necessary to promote the child's best interest.\n(5) A foster parent's bedroom may only be shared with a foster child who is under the age of two years old.\n(6) A foster parent may not share a bed with any foster child.","path":["Title 26B Utah Health and Human Services Code","Chapter 26B-2 Licensing and Certifications","Part 26B-2-1 Human Services Programs and Facilities"],"source_url":"https://le.utah.gov/xcode/Title26B/Chapter2/26B-2-S128.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"456cb0ecb7c6451ea02f5d6959d77abf8a8267d1ba4c4b326ef9c90460599b32","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-26b-2-127","next":"us-ut/utah-code-26b-2-129"},"notice":"GroundRules: Original legal text.
