{"data":{"id":"us-ut/utah-code-26b-2-245","jurisdiction":"us-ut","citation":"Utah Code § 26B-2-245","heading":"Workplace violence incident reporting in hospitals.","body":"(1) As used in this section:\n(a) \"Hospital\" means:\n(i) a general acute hospital, as that term is defined in Section 26B-2-201; or\n(ii) a specialty hospital, as that term is defined in Section 26B-2-201.\n(b) \"Workplace violence\" means the same as that term is defined in Section 78B-7-1101.\n(2) On or before November 1, 2026, a hospital shall:\n(a) establish a workplace violence incident reporting system;\n(b) record all reported incidents of workplace violence as voluntarily reported by an employee;\n(c) adopt a policy that prohibits discrimination or retaliation against an employee for reporting or participating in an investigation;\n(d) analyze collected data;\n(e) maintain the record of reported workplace violence incidents for at least two years; and\n(f) report data collected to the chief medical officer and the chief nursing officer on a quarterly basis.\n(3) A workplace violence incident reporting system shall:\n(a) collect information regarding a workplace violence incident, including:\n(i) the date and time of the incident;\n(ii) a description of the incident;\n(iii) the job category of the victim employees;\n(iv) whether the perpetrator was a patient, visitor, or employee; and\n(v) the immediate response to the incident;\n(b) be clearly communicated to all employees, including new employees at orientation;\n(c) include guidelines on when and how to report incidents of workplace violence to an employer, security agencies, and appropriate law enforcement authorities; and\n(d) be used to make improvements in preventing workplace violence, including improvements achieved through continuing education in targeted areas, de-escalation training, risk identification, and violence prevention planning.\n(4) A hospital shall report the number of workplace violence incidents annually to the department.","path":["Title 26B Utah Health and Human Services Code","Chapter 26B-2 Licensing and Certifications","Part 26B-2-2 Health Care Facility Licensing and Inspection"],"source_url":"https://le.utah.gov/xcode/Title26B/Chapter2/26B-2-S245.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"bc141eae742111f508ca50746cd557e61bff16137e70258ff725e444efb4ee24","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-26b-2-244","next":"us-ut/utah-code-26b-2-246"},"notice":"GroundRules: Original legal text.
