{"data":{"id":"us-ut/utah-code-26b-2-403","jurisdiction":"us-ut","citation":"Utah Code § 26B-2-403","heading":"Licensure requirements -- Expiration -- Renewal.","body":"(1) Except as provided in Section 26B-2-405, and subject to Subsection (2), a person shall obtain a license from the department if:\n(a) the person provides center based child care for five or more qualifying children;\n(b) the person provides residential child care for nine or more qualifying children; or\n(c) the person:\n(i) provides child care;\n(ii) is not required to obtain a license under Subsection (1)(a) or (b); and\n(iii) requests to be licensed.\n(2) Notwithstanding Subsection (1), a certified provider may, in accordance with rules made by the department under Subsection 26B-2-402(3), exceed the certified provider's capacity limit to provide after school child care without obtaining a license from the department.\n(3) The department may issue licenses for a period not exceeding 24 months to child care providers who meet the requirements of:\n(a) this part; and\n(b) the department's rules governing child care programs.\n(4) A license issued under this part is not assignable or transferable.","path":["Title 26B Utah Health and Human Services Code","Chapter 26B-2 Licensing and Certifications","Part 26B-2-4 Child Care Licensing"],"source_url":"https://le.utah.gov/xcode/Title26B/Chapter2/26B-2-S403.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"4e7194a8687b6042c1bea755bd5e3ea67976de3de6d6f6fbd5f6c89140f2a9aa","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-26b-2-402","next":"us-ut/utah-code-26b-2-404"},"notice":"GroundRules: Original legal text.
