{"data":{"id":"us-ut/utah-code-26b-3-231","jurisdiction":"us-ut","citation":"Utah Code § 26B-3-231","heading":"Medicaid waiver for minor beneficiaries.","body":"(1) As used in this section:\n(a) \"ABLE account\" means the same as that term is defined in Section 80-2-504.\n(b) \"Federal benefit\" means the same as that term is defined in Section 80-2-504.\n(c) \"Minor beneficiary\" means the same as that term is defined in Section 80-2-504.\n(d) \"Qualified minor\" means a minor beneficiary who is not eligible for an ABLE account or other account that would allow the funds in the account to be disregarded for the purpose of determining resource-eligibility for Medicaid.\n(2) On or before January 1, 2026, the department shall apply for a Medicaid waiver or state plan amendment to:\n(a) disregard a qualified minor's federal benefit for the purpose of determining resource-eligibility for Medicaid; or\n(b) increase the resource-eligibility limit for qualified minors to an amount that would allow qualified minors to remain resource-eligible for Medicaid while also continuing to receive federal benefits.","path":["Title 26B Utah Health and Human Services Code","Chapter 26B-3 Health Care - Administration and Assistance","Part 26B-3-2 Medicaid Waivers"],"source_url":"https://le.utah.gov/xcode/Title26B/Chapter3/26B-3-S231.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"d41fb0c3c68b4906c266d878e8a3beeaf90455fd4a79c2f86b10980d9866c62f","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-26b-3-230","next":"us-ut/utah-code-26b-3-232"},"notice":"GroundRules: Original legal text.
