{"data":{"id":"us-ut/utah-code-26b-3-508","jurisdiction":"us-ut","citation":"Utah Code § 26B-3-508","heading":"State teaching hospital and non-state government hospital mandatory intergovernmental transfer.","body":"(1) The state teaching hospital and a non-state government hospital shall make an intergovernmental transfer to the Medicaid ACA Fund created in Section 26B-1-315, in accordance with this section.\n(2) The hospitals described in Subsection (1) shall pay the intergovernmental transfer beginning on the later of CMS approval of:\n(a) the health improvement program waiver under Section 26B-3-207; or\n(b) the assessment for private hospitals in this part.\n(3) The intergovernmental transfer is apportioned as follows:\n(a) the state teaching hospital is responsible for:\n(i) 30% of the portion of the hospital share specified in Subsections 26B-3-506(1)(a) through (c); and\n(ii) 0% of the hospital share specified in Subsection 26B-3-506(1)(d); and\n(b) non-state government hospitals are responsible for:\n(i) 1% of the portion of the hospital share specified in Subsections 26B-3-506(1)(a) through (c); and\n(ii) 0% of the hospital share specified in Subsection 26B-3-506(1)(d).\n(4) The department shall, by rule made in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, designate:\n(a) the method of calculating the amounts designated in Subsection (3); and\n(b) the schedule for the intergovernmental transfers.","path":["Title 26B Utah Health and Human Services Code","Chapter 26B-3 Health Care - Administration and Assistance","Part 26B-3-5 Inpatient Hospital Assessment"],"source_url":"https://le.utah.gov/xcode/Title26B/Chapter3/26B-3-S508.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"91fb8115fb94c8c32758aeced337eb35a6cdbcedd9132b558af86efc5c45eea1","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-26b-3-507","next":"us-ut/utah-code-26b-3-509"},"notice":"GroundRules: Original legal text.
