{"data":{"id":"us-ut/utah-code-26b-3-509","jurisdiction":"us-ut","citation":"Utah Code § 26B-3-509","heading":"Penalties and interest.","body":"(1) A hospital that fails to pay a quarterly assessment, make the mandated intergovernmental transfer, or file a return as required under this part, within the time required by this part, shall pay penalties described in this section, in addition to the assessment or intergovernmental transfer.\n(2) If a hospital fails to timely pay the full amount of a quarterly assessment or the mandated intergovernmental transfer, the department shall add to the assessment or intergovernmental transfer:\n(a) a penalty equal to 5% of the quarterly amount not paid on or before the due date; and\n(b) on the last day of each quarter after the due date until the assessed amount and the penalty imposed under Subsection (2)(a) are paid in full, an additional 5% penalty on:\n(i) any unpaid quarterly assessment or intergovernmental transfer; and\n(ii) any unpaid penalty assessment.\n(3) Upon making a record of the division's actions, and upon reasonable cause shown, the division may waive, reduce, or compromise any of the penalties imposed under this part.","path":["Title 26B Utah Health and Human Services Code","Chapter 26B-3 Health Care - Administration and Assistance","Part 26B-3-5 Inpatient Hospital Assessment"],"source_url":"https://le.utah.gov/xcode/Title26B/Chapter3/26B-3-S509.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"ac4fcab82c3f82b2a8dff933b30885181910e43d046728bfc3b14fc0b4e25c56","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-26b-3-508","next":"us-ut/utah-code-26b-3-510"},"notice":"GroundRules: Original legal text.
