{"data":{"id":"us-ut/utah-code-26b-3-609","jurisdiction":"us-ut","citation":"Utah Code § 26B-3-609","heading":"Penalties.","body":"(1) A hospital that fails to pay a quarterly assessment, make the mandated intergovernmental transfer, or file a return as required under this part, within the time required by this part, shall pay penalties described in this section, in addition to the assessment or intergovernmental transfer.\n(2) If a hospital fails to timely pay the full amount of a quarterly assessment or the mandated intergovernmental transfer, the department shall add to the assessment or intergovernmental transfer:\n(a) a penalty equal to 5% of the quarterly amount not paid on or before the due date; and\n(b) on the last day of each quarter after the due date until the assessed amount and the penalty imposed under Subsection (2)(a) are paid in full, an additional 5% penalty on:\n(i) any unpaid quarterly assessment or intergovernmental transfer; and\n(ii) any unpaid penalty assessment.\n(3) Upon making a record of the division's actions, and upon reasonable cause shown, the division may waive or reduce any of the penalties imposed under this part.","path":["Title 26B Utah Health and Human Services Code","Chapter 26B-3 Health Care - Administration and Assistance","Part 26B-3-6 Medicaid Expansion Hospital Assessment"],"source_url":"https://le.utah.gov/xcode/Title26B/Chapter3/26B-3-S609.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"e5fbb5d358540dcc5ce0ee0837a81d82faa9a3bf23c3ea72462d6fa724cf691c","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-26b-3-608","next":"us-ut/utah-code-26b-3-610"},"notice":"GroundRules: Original legal text.
