{"data":{"id":"us-ut/utah-code-26b-4-220","jurisdiction":"us-ut","citation":"Utah Code § 26B-4-220","heading":"Enforcement -- Misdemeanor.","body":"(1) Except as provided in Title 4, Chapter 41a, Cannabis Production Establishments and Pharmacies, it is unlawful for a medical cannabis cardholder to sell or otherwise give to another medical cannabis cardholder cannabis in a medicinal dosage form, a cannabis product in a medicinal dosage form, a medical cannabis device, or any cannabis residue remaining in or from a medical cannabis device.\n(2)\n(a) Except as provided in Subsection (2)(b), a medical cannabis cardholder who violates Subsection (1) is:\n(i) guilty of a class B misdemeanor; and\n(ii) subject to a $1,000 fine.\n(b) An individual is not guilty under Subsection (2)(a) if the individual:\n(i)\n(A) is a designated caregiver; and\n(B) gives the product described in Subsection (1) to the medical cannabis cardholder who designated the individual as a designated caregiver; or\n(ii)\n(A) is a medical cannabis guardian cardholder; and\n(B) gives the product described in Subsection (1) to the relevant provisional patient cardholder.\n(c) An individual who is guilty of a violation described in Subsection (2)(a) is not guilty of a violation of Title 58, Chapter 37, Controlled Substances, or Title 76, Chapter 18, Part 2, Offenses Concerning Controlled Substances, for the conduct underlying the violation described in Subsection (2)(a).","path":["Title 26B Utah Health and Human Services Code","Chapter 26B-4 Health Care - Delivery and Access","Part 26B-4-2 Cannabinoid Research and Medical Cannabis"],"source_url":"https://le.utah.gov/xcode/Title26B/Chapter4/26B-4-S220.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"e0148939c70c36bdf5b176802beac2c92303a04abda132320dc6497ba3398247","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-26b-4-219","next":"us-ut/utah-code-26b-4-222"},"notice":"GroundRules: Original legal text.
