{"data":{"id":"us-ut/utah-code-26b-4-245","jurisdiction":"us-ut","citation":"Utah Code § 26B-4-245","heading":"Purchasing and use limitations.","body":"(1) An individual with a medical cannabis card:\n(a) may purchase, in any one 28-day period, up to the legal dosage limit of:\n(i) unprocessed cannabis in a medicinal dosage form; and\n(ii) a cannabis product in a medicinal dosage form;\n(b) may not purchase:\n(i) except as provided in Subsection (2), more medical cannabis than described in Subsection (1)(a); or\n(ii) if the relevant recommending medical provider did not recommend directions of use and dosing guidelines, until the individual consults with the pharmacy medical provider in accordance with Subsection 26B-4-231(5), any medical cannabis; and\n(c) may not use a route of administration that the relevant recommending medical provider or the pharmacy medical provider, in accordance with Subsection 26B-4-231(5), has not recommended.\n(2)\n(a) A recommending medical provider may petition the department to waive the 28-day period limit described in Subsection (1)(a) for a medical cannabis cardholder if the medical cannabis cardholder:\n(i) has been diagnosed with a terminal illness;\n(ii) has a life expectancy of six months or less; and\n(iii) needs the waiver for palliative purposes.\n(b) The department shall:\n(i) consult with the Compassionate Use Board to determine whether the waiver should be granted; and\n(ii) issue a response to the petition within 10 days from the day on which the petition is received.\n(c) The department may waive the 28-day period limit for no more than 180 days.\n(d) A petition described in this Subsection (2) may be combined with the petition described in Subsection 4-41a-112(5).","path":["Title 26B Utah Health and Human Services Code","Chapter 26B-4 Health Care - Delivery and Access","Part 26B-4-2 Cannabinoid Research and Medical Cannabis"],"source_url":"https://le.utah.gov/xcode/Title26B/Chapter4/26B-4-S245.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"0699ba67a4ab2f84b18859485922c708e14cdaf9220b7ab25d55749b9ee51b89","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-26b-4-244","next":"us-ut/utah-code-26b-4-246"},"notice":"GroundRules: Original legal text.
