{"data":{"id":"us-ut/utah-code-26b-7-507","jurisdiction":"us-ut","citation":"Utah Code § 26B-7-507","heading":"Permitting requirement.","body":"(1)\n(a) A tobacco retailer shall hold a valid tobacco retail permit issued in accordance with this part by the local health department with jurisdiction over the physical location where the tobacco retailer operates.\n(b) A tobacco retailer without a valid permit may not:\n(i) place a tobacco product, an electronic cigarette product, or a nicotine product in public view;\n(ii) display any advertisement related to a tobacco product, an electronic cigarette product, or a nicotine product that promotes the sale, distribution, or use of those products; or\n(iii) sell, offer for sale, or offer to exchange for any form of consideration, tobacco, a tobacco product, an electronic cigarette product, or a nicotine product.\n(2) A local health department may issue a permit under this part for a tobacco retailer in the classification of:\n(a) a general tobacco retailer; or\n(b) a retail tobacco specialty business.\n(3) A permit under this part is:\n(a) valid only for one physical location, including a vending machine;\n(b) valid only at one fixed business address; and\n(c) if multiple tobacco retailers are at the same address, separately required for each tobacco retailer.","path":["Title 26B Utah Health and Human Services Code","Chapter 26B-7 Public Health and Prevention","Part 26B-7-5 Regulation of Smoking, Tobacco Products, and Nicotine Products"],"source_url":"https://le.utah.gov/xcode/Title26B/Chapter7/26B-7-S507.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"7e9718ad966cb062351c4f331d5c68dd2c42972967eef8023cea5181b4f7c4fe","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-26b-7-506","next":"us-ut/utah-code-26b-7-508"},"notice":"GroundRules: Original legal text.
