{"data":{"id":"us-ut/utah-code-31a-2-216","jurisdiction":"us-ut","citation":"Utah Code § 31A-2-216","heading":"Office of Consumer Health Assistance.","body":"(1) The commissioner shall establish an Office of Consumer Health Assistance before July 1, 1999.\n(2) The office shall:\n(a) be a resource for health insurance consumers concerning health insurance coverage or the need for such coverage;\n(b) help health insurance consumers understand:\n(i) contractual rights and responsibilities;\n(ii) statutory protections; and\n(iii) available remedies, including adverse benefit determination processes;\n(c) educate health insurance consumers:\n(i) by producing or collecting and disseminating educational materials to consumersand health insurers; and\n(ii) through outreach and other educational activities;\n(d) for health insurance consumers that have difficulty in accessing their health insurance policies because of language, disability, age, or ethnicity, provide information and services, directly or through referral;\n(e) analyze and monitor federal and state consumer health insurance statutes, rules, and regulations; and\n(f) summarize information gathered under this section and make the summaries available to the public, government agencies, and the Legislature.\n(3) The office may:\n(a) obtain data from health insurance consumers as necessary to further the office's duties under this section;\n(b) investigate complaints and attempt to resolve complaints at the lowest possible level; and\n(c) assist, but not testify or represent, a consumer in an adverse benefit determination, arbitration, judicial, or related proceeding, unless the proceeding is in connection with an enforcement action under Section 31A-2-308.\n(4) The commissioner may adopt rules necessary to implement the requirements of this section.","path":["Title 31A Insurance Code","Chapter 31A-2 Administration of the Insurance Laws","Part 31A-2-2 Duties and Powers of Commissioner"],"source_url":"https://le.utah.gov/xcode/Title31A/Chapter2/31A-2-S216.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"1f7ff3c3e97830c98e5b1d19bffea18aaedeb38f0a50b27e2dc4ef967d7cdf6b","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-31a-2-215","next":"us-ut/utah-code-31a-2-217"},"notice":"GroundRules: Original legal text.
