{"data":{"id":"us-ut/utah-code-31a-23a-104","jurisdiction":"us-ut","citation":"Utah Code § 31A-23a-104","heading":"Application for individual license -- Application for agency license.","body":"(1) This section applies to an initial or renewal license as a:\n(a) producer;\n(b) surplus lines producer;\n(c) limited line producer;\n(d) consultant;\n(e) managing general agent; or\n(f) reinsurance intermediary.\n(2)\n(a) Subject to Subsection (2)(b), to obtain or renew an individual license, an individual shall:\n(i) file an application for an initial or renewal individual license with the commissioner on forms and in a manner the commissioner prescribes; and\n(ii) except as provided in Subsection (6), pay a license fee that is not refunded if the application:\n(A) is denied; or\n(B) is incomplete when filed and is never completed by the applicant.\n(b) An application described in this Subsection (2) shall provide:\n(i) information about the applicant's identity;\n(ii) the applicant's Social Security number;\n(iii) the applicant's personal history, experience, education, and business record;\n(iv) whether the applicant is 18 years old or older;\n(v) whether the applicant has committed an act that is a ground for denial, suspension, or revocation as set forth in Section 31A-23a-105 or 31A-23a-111;\n(vi) if the application is for a resident individual producer license, certification that the applicant complies with Section 31A-23a-203.5; and\n(vii) any other information the commissioner reasonably requires.\n(3) The commissioner may require a document reasonably necessary to verify the information contained in an application filed under this section.\n(4) An applicant's Social Security number contained in an application filed under this section is a private record under Section 63G-2-302.\n(5)\n(a) Subject to Subsection (5)(b), to obtain or renew an agency license, a person shall:\n(i) file an application for an initial or renewal agency license with the commissioner on forms and in a manner the commissioner prescribes; and\n(ii) pay a license fee that is not refunded if the application:\n(A) is denied; or\n(B) is incomplete when filed and is never completed by the applicant.\n(b) An application described in Subsection (5)(a) shall provide:\n(i) information about the applicant's identity;\n(ii) the applicant's federal employer identification number;\n(iii) the designated responsible licensed individual;\n(iv) the identity of the owners, partners, officers, and directors;\n(v) whether the applicant has committed an act that is a ground for denial, suspension, or revocation as set forth in Section 31A-23a-105 or 31A-23a-111; and\n(vi) any other information the commissioner reasonably requires.\n(6) The following individuals are exempt from paying a license fee:\n(a) an individual serving in the armed forces of the United States while the individual is stationed within this state, if:\n(i) the individual holds a valid license to practice the regulated occupation or profession issued by any other state or jurisdiction recognized by the department; and\n(ii) the license is current and the individual is in good standing in the state or jurisdiction of licensure; and\n(b) the spouse of an individual serving in the armed forces of the United States or the spouse of a DOD civilian while the individual or DOD civilian is stationed within this state, if:\n(i) the spouse holds a valid license to practice the regulated occupation or profession issued by any other state or jurisdiction recognized by the department; and\n(ii) the license is current and the spouse is in good standing in the state or jurisdiction of licensure.","path":["Title 31A Insurance Code","Chapter 31A-23a Insurance Marketing - Licensing Producers, Consultants, and Reinsurance Intermediaries","Part 31A-23a-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title31A/Chapter23a/31A-23a-S104.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"3be834b982639d5c28261082040baa64aeb8cd8ae3a15743cff0f888dc9040af","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-31a-23a-103","next":"us-ut/utah-code-31a-23a-105"},"notice":"GroundRules: Original legal text.
