{"data":{"id":"us-ut/utah-code-31a-26-406","jurisdiction":"us-ut","citation":"Utah Code § 31A-26-406","heading":"Record retention requirements.","body":"(1) A public adjuster shall keep at the public adjuster's address that the public adjuster registers with the commissioner a record of each investigation, adjustment, or transaction the public adjuster undertakes or completes under the public adjuster's license.\n(2) For each investigation, adjustment, or transaction, a record described in Subsection (1) shall include:\n(a) the name of the insured;\n(b) the date, location, and amount of the loss the insured incurs;\n(c) a copy of the contract between the public adjuster and the insured;\n(d) for each policy an insured carries that relates to the loss the insured incurs:\n(i) the name of the insurer;\n(ii) the amount of the policy;\n(iii) the expiration date of the policy; and\n(iv) the number of the policy;\n(e) an itemized statement of each of the insured's recoveries;\n(f) an itemized statement of all compensation the public adjuster receives in connection with the investigation, adjustment, or transaction;\n(g) a register of all money the public adjuster receives, deposits, disburses, or withdraws in connection with a transaction with an insured, including:\n(i) a fee transfer;\n(ii) a disbursement from a trust account; or\n(iii) a transaction that involves an interest-bearing account;\n(h) the name of the public adjuster that executed the contract;\n(i) the name of the attorney that represents the insured, if applicable;\n(j) the name of the insurance company's claims representative; and\n(k) documentation that the public adjuster meets all applicable statutory financial responsibility requirements.","path":["Title 31A Insurance Code","Chapter 31A-26 Insurance Adjusters","Part 31A-26-4 Public Adjusters"],"source_url":"https://le.utah.gov/xcode/Title31A/Chapter26/31A-26-S406.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"bffb602376db85a136293c63540630e36cf1493b9fe1c042e7a945787c0cd0f6","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-31a-26-405","next":"us-ut/utah-code-31a-26-407"},"notice":"GroundRules: Original legal text.
