{"data":{"id":"us-ut/utah-code-31a-27a-110","jurisdiction":"us-ut","citation":"Utah Code § 31A-27a-110","heading":"Cooperation of officers, owners, and employees.","body":"(1) As used in this section:\n(a) \"Cooperate\" includes to:\n(i) reply promptly in writing to an inquiry from the commissioner or receiver requesting a reply; and\n(ii) promptly make available to the commissioner or receiver any record, account, information, or property:\n(A) of or pertaining to the insurer; and\n(B) in the person's possession, custody, or control.\n(b) \"Person\" includes a person who exercises control directly or indirectly over activities of the insurer through:\n(i) a holding company; or\n(ii) other affiliate of the insurer.\n(2) The following shall cooperate with the commissioner or receiver in a proceeding under this chapter or an investigation preliminary to a proceeding under this chapter:\n(a) a present or former officer, manager, director, trustee, owner, or employee of an insurer;\n(b) a present or former agent of an insurer; or\n(c) a person with authority over or in charge of any segment of the insurer's affairs.\n(3) A person may not obstruct or interfere with the commissioner or receiver in the conduct of:\n(a) a delinquency proceeding; or\n(b) an investigation preliminary or incidental to a delinquency proceeding.\n(4) This section may not be construed to abridge otherwise existing legal rights, including the right to resist:\n(a) a petition for liquidation or other delinquency proceeding; or\n(b) other orders.\n(5)\n(a) A person described in Subsection (5)(b) is:\n(i) guilty of a class B misdemeanor, except that the fine may exceed $1,000 but may not exceed $10,000; or\n(ii) after a hearing, subject to:\n(A) the commissioner imposing a civil penalty that may not exceed $10,000;\n(B) the revocation or suspension of an insurance license issued by the commissioner; or\n(C) a combination of Subsections (5)(a)(ii)(A) and (B).\n(b) This Subsection (5) applies to:\n(i) a person described in Subsection (2) who fails to cooperate with the commissioner or receiver;\n(ii) a person who obstructs or interferes with the commissioner or receiver in the conduct of a delinquency proceeding or an investigation preliminary or incidental to a delinquency proceeding; or\n(iii) a person who violates an order validly issued under this chapter.","path":["Title 31A Insurance Code","Chapter 31A-27a Insurer Receivership Act","Part 31A-27a-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title31A/Chapter27a/31A-27a-S110.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"691f73de49486c2bcfce835d22151c718bbfeba531b5ff614b81b911a4918e34","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-31a-27a-109","next":"us-ut/utah-code-31a-27a-111"},"notice":"GroundRules: Original legal text.
