{"data":{"id":"us-ut/utah-code-31a-27a-112","jurisdiction":"us-ut","citation":"Utah Code § 31A-27a-112","heading":"Unrecorded obligations and defenses of affiliates.","body":"(1) This section applies to a person who in relation to an insurer is:\n(a) an affiliate;\n(b) a controlled or controlling person; or\n(c) a present or former officer, manager, director, trustee, or shareholder.\n(2) In a proceeding or claim by the receiver, a person described in Subsection (1) may not assert a defense unless evidence of the defense:\n(a) is recorded in the records of the insurer at or about the time the event giving rise to the defense occurs; and\n(b) if required by statutory accounting practices and procedures, is timely reported on the insurer's official financial statements filed with the commissioner.\n(3) A person described in Subsection (1) may not assert a claim, unless the obligation:\n(a) is recorded in the records of the insurer at or about the time the obligation is incurred; and\n(b) if required by statutory accounting practices and procedures, is timely reported on the insurer's official financial statements filed with the commissioner.\n(4) A claim by the receiver against a person described in Subsection (1) that is made on the basis of an unrecorded or unreported transaction is not barred by this section.","path":["Title 31A Insurance Code","Chapter 31A-27a Insurer Receivership Act","Part 31A-27a-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title31A/Chapter27a/31A-27a-S112.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"a5dc501f85eeee5d962c82d1da6c2835c4ab87460621a00cdfffa4d65640afff","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-31a-27a-111","next":"us-ut/utah-code-31a-27a-113"},"notice":"GroundRules: Original legal text.
