{"data":{"id":"us-ut/utah-code-31a-31-102","jurisdiction":"us-ut","citation":"Utah Code § 31A-31-102","heading":"Definitions.","body":"As used in this chapter:\n(1) \"Authorized agency\" means:\n(a) the attorney general;\n(b) the state fire marshal;\n(c) any state law enforcement agency;\n(d) any criminal investigative department or agency of the United States;\n(e) a district attorney;\n(f) the prosecuting attorney of any municipality or county;\n(g) the department; or\n(h) the disciplinary section of an agency licensing a service provider.\n(2) \"Financial loss\" includes:\n(a) out-of-pocket expenses;\n(b) reasonable attorney fees;\n(c) repair and replacement costs; or\n(d) claims payments.\n(3) \"Insurer\" means any person or aggregation of persons:\n(a) doing insurance business, as defined in Section 31A-1-301; or\n(b) subject to the supervision of the commissioner under:\n(i) this title; or\n(ii) any equivalent insurance supervisory official of another state.\n(4) \"Knowingly\" has the same meaning as in Subsection 76-2-103(2).\n(5) \"Person\" means an individual, firm, company, corporation, association, limited liability company, partnership, organization, society, business trust, service provider, or any other legal entity.\n(6)\n(a) \"Runner\" means a person who procures clients at the direction of, or in cooperation with a person who intends to:\n(i) perform or obtain a service or benefit under a contract of insurance; or\n(ii) assert a claim against an insured.\n(b) \"Runner\" includes:\n(i) a capper; or\n(ii) a steerer.\n(7) \"Service provider\" means:\n(a) an individual licensed to practice law;\n(b) an individual licensed or certified by the state under:\n(i) this title;\n(ii) Title 41, Chapter 3, Motor Vehicle Business Regulation Act;\n(iii) Title 58, Occupations and Professions; or\n(iv) Title 61, Securities Division - Real Estate Division;\n(c) an individual licensed in another jurisdiction in a manner similar to a license described in Subsection (7)(a) or (b);\n(d) an individual practicing any nonmedical treatment rendered in accordance with a recognized religious method of healing; or\n(e) a hospital, health care facility, or person whose services are compensated directly or indirectly by insurance.\n(8) \"Statement\" includes any:\n(a)\n(i) notice;\n(ii) statement;\n(iii) proof of loss;\n(iv) bill of lading;\n(v) receipt for payment;\n(vi) invoice;\n(vii) account;\n(viii) estimate of property damage;\n(ix) bill for services;\n(x) diagnosis;\n(xi) prescription;\n(xii) hospital or doctor record;\n(xiii) x-ray;\n(xiv) test result; or\n(xv) other evidence of loss, injury, or expense; or\n(b) item listed in Subsection (8)(a) that is a computer-generated document.","path":["Title 31A Insurance Code","Chapter 31A-31 Insurance Fraud Act"],"source_url":"https://le.utah.gov/xcode/Title31A/Chapter31/31A-31-S102.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"952e621180d17e93ab84d67d5699ea65eff738180606627bcee5e8db952ee785","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-31a-31-101","next":"us-ut/utah-code-31a-31-103"},"notice":"GroundRules: Original legal text.
