{"data":{"id":"us-ut/utah-code-31a-35-702","jurisdiction":"us-ut","citation":"Utah Code § 31A-35-702","heading":"Early surrender without cause.","body":"(1) The bail or bail bond premium shall be returned in full if a bail bond producer without good cause surrenders a defendant to custody before:\n(a) the time specified in the undertaking of bail or the bail bond for the appearance of the defendant; or\n(b) any other occasion where the presence of the defendant in court is lawfully required.\n(2) As used in this section, \"good cause\" includes:\n(a) the defendant providing materially false information on the application for bail or a bail bond;\n(b) the court's increasing the amount of bail beyond sound underwriting criteria employed by:\n(i) the bail bond producer; or\n(ii) the bail bond agency;\n(c) a material and detrimental change in the collateral posted by:\n(i) the defendant; or\n(ii) a person acting on the defendant's behalf;\n(d) the defendant changing the defendant's address or telephone number without giving reasonable notice to:\n(i) the bail bond producer; or\n(ii) the bail bond agency;\n(e) the defendant commits another crime, other than a minor traffic violation, as defined by department rule, while on bail;\n(f) failure by the defendant to appear in court at the appointed time; or\n(g) a finding of guilt against the defendant by a court of competent jurisdiction.","path":["Title 31A Insurance Code","Chapter 31A-35 Bail Bond Act","Part 31A-35-7 Prohibitions and Penalties"],"source_url":"https://le.utah.gov/xcode/Title31A/Chapter35/31A-35-S702.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"0f965609e9195527a6495b78c600e530dca178aac76a6f704f8c597e696f3435","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-31a-35-701","next":"us-ut/utah-code-31a-35-703"},"notice":"GroundRules: Original legal text.
