{"data":{"id":"us-ut/utah-code-31a-36-119","jurisdiction":"us-ut","citation":"Utah Code § 31A-36-119","heading":"Authority to make rules.","body":"In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the commissioner may adopt rules to:\n(1) establish the requirements for the annual report required under Section 31A-36-106;\n(2) establish standards for evaluating the reasonableness of payments under life settlements;\n(3) establish appropriate licensing requirements, fees, and standards for continued licensure for:\n(a) a life settlement provider; and\n(b) a life settlement producer;\n(4)\n(a) determine the amount and conditions of a bond or other assurance of financial responsibility required under Section 31A-23a-117 for a life settlement provider; and\n(b) require, determine the amount, or determine the conditions of an assurance of financial responsibility for a life settlement producer, including a bond or an errors and omissions insurance policy;\n(5) govern the relationship of insurers with a life settlement provider or life settlement producer during the settlement of a policy;\n(6) determine the specific disclosures required under Section 31A-36-108;\n(7) determine whether advertising for life settlements violates Section 31A-36-112;\n(8) determine the information to be provided to the commissioner under Section 31A-36-114 and the manner of providing the information;\n(9) determine additional acts or practices that are prohibited under Section 31A-36-111;\n(10) establish payment requirements for the payments in Section 31A-36-110; and\n(11) establish the filing procedure for the forms listed in Subsection 31A-36-105(1).","path":["Title 31A Insurance Code","Chapter 31A-36 Life Settlements Act"],"source_url":"https://le.utah.gov/xcode/Title31A/Chapter36/31A-36-S119.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"a31c8c7285c9e0e4b663ebedf36db5a2faeb6dd0b74d99d2dc149b2d822704d0","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-31a-36-118","next":"us-ut/utah-code-31a-37-101"},"notice":"GroundRules: Original legal text.
