{"data":{"id":"us-ut/utah-code-31a-40-201","jurisdiction":"us-ut","citation":"Utah Code § 31A-40-201","heading":"Enforceable rights and obligations.","body":"(1) In a coemployment relationship under a professional employer agreement:\n(a) a professional employer organization:\n(i) may only enforce a right of an employer that is specifically allocated to the professional employer organization under the professional employer agreement or this chapter; and\n(ii) is subject only to an obligation of an employer specifically allocated to the professional employer organization by the professional employer agreement or this chapter; and\n(b) a client:\n(i) may enforce a right of an employer:\n(A) allocated to the client in the professional employer agreement or this chapter; or\n(B) not specifically allocated to the professional employer organization under the professional employer agreement or this chapter; and\n(ii) is subject to an obligation of an employer:\n(A) allocated to the client by the professional employer agreement or this chapter; or\n(B) not specifically allocated to a professional employer organization by the professional employer agreement or this chapter.\n(2) A right or obligation of a professional employer organization as a coemployer of a covered employee is limited to a right or obligation arising pursuant to the professional employer agreement and this chapter during the term of coemployment of the covered employee by the professional employer organization.","path":["Title 31A Insurance Code","Chapter 31A-40 Professional Employer Organization Licensing Act","Part 31A-40-2 Coemployment Relationship and Professional Employer Services"],"source_url":"https://le.utah.gov/xcode/Title31A/Chapter40/31A-40-S201.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"016a4781c9761bc6376a9835cea22c36100bcaec6e36446562f47615e2530b1b","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-31a-40-104","next":"us-ut/utah-code-31a-40-202"},"notice":"GroundRules: Original legal text.
