{"data":{"id":"us-ut/utah-code-31a-40-203","jurisdiction":"us-ut","citation":"Utah Code § 31A-40-203","heading":"Covered employee.","body":"(1)\n(a) An individual is a covered employee of a professional employer organization if the individual is coemployed pursuant to a professional employer agreement subject to this chapter.\n(b) An individual who is a covered employee under a professional employer agreement is a covered employee, whether or not the professional employer organization provides the notice required by Subsection 31A-40-202(3), the earlier of the day on which:\n(i) the employee is first compensated by the professional employer organization; or\n(ii) the client notifies the professional employer organization of a new hire.\n(2) An individual who is an officer, director, shareholder, partner, or manager of a client is a covered employee:\n(a) to the extent that the client and the professional employer organization expressly agree in the professional employer agreement that the individual is a covered employee;\n(b) if the conditions of Subsection (1) are met; and\n(c) if the individual acts as an operational manager or performs day-to-day an operational service for the client.","path":["Title 31A Insurance Code","Chapter 31A-40 Professional Employer Organization Licensing Act","Part 31A-40-2 Coemployment Relationship and Professional Employer Services"],"source_url":"https://le.utah.gov/xcode/Title31A/Chapter40/31A-40-S203.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"5bb7801e5d6c1e851a3fb7122086b58a3a74d7294b1ccde971bc193b18c892e0","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-31a-40-202","next":"us-ut/utah-code-31a-40-204"},"notice":"GroundRules: Original legal text.
