{"data":{"id":"us-ut/utah-code-31a-40-304","jurisdiction":"us-ut","citation":"Utah Code § 31A-40-304","heading":"Small operation license.","body":"(1) A professional employer organization may obtain a small operation license under this chapter if the professional employer organization:\n(a) files an application for a small operation license with the commissioner:\n(i) on a form and in a manner the commissioner shall determine by rule made in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act; and\n(ii) that includes the information and documentation the commissioner determines is necessary to show that the professional employer organization qualifies for a small operation license;\n(b) pays a small operation license fee determined in accordance with Section 31A-3-103, that is not refunded if the application:\n(i) is denied; or\n(ii) if incomplete, is never completed by the person filing the application;\n(c) is domiciled outside of this state;\n(d) is licensed or registered as a professional employer organization in another state;\n(e) does not maintain an office in this state or directly solicit a client that:\n(i) is domiciled in this state; or\n(ii) maintains a location within this state;\n(f) does not have at any time more than 50 covered employees employed or domiciled in this state; and\n(g) is not owned or directed by another professional employer organization operating in the state.\n(2)\n(a) A small operation license is valid for one year.\n(b) A professional employer organization may annually renew a small operation license.\n(3) A professional employer organization with a small operation license under this chapter is not subject to Section 31A-40-205.","path":["Title 31A Insurance Code","Chapter 31A-40 Professional Employer Organization Licensing Act","Part 31A-40-3 Licensing Requirements"],"source_url":"https://le.utah.gov/xcode/Title31A/Chapter40/31A-40-S304.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"44726000b6206f0e084a94338212cf98aad7913b5e4ca115d0e90b74b58b7428","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-31a-40-303","next":"us-ut/utah-code-31a-40-305"},"notice":"GroundRules: Original legal text.
