{"data":{"id":"us-ut/utah-code-31a-40-402","jurisdiction":"us-ut","citation":"Utah Code § 31A-40-402","heading":"Disciplinary action.","body":"(1) Notwithstanding Section 31A-2-308, in accordance with this section the commissioner may take action against a person if the commissioner finds that the person:\n(a) is violating or has violated Section 31A-40-401; or\n(b)\n(i) is a:\n(A) professional employer organization licensed under this chapter; or\n(B) controlling person of a professional employer organization licensed under this chapter; and\n(ii) is convicted of a crime that relates to:\n(A) the operation of a professional employer organization;\n(B) fraud or deceit; or\n(C) the ability of the professional employer organization or a controlling person of the professional employer organization to operate a professional employer organization.\n(2) After notice and an opportunity for a hearing in accordance with Title 63G, Chapter 4, Administrative Procedures Act, if the commissioner makes a finding described in Subsection (1), the commissioner may:\n(a) deny an application for a license;\n(b) revoke, restrict, or refuse to renew a license;\n(c) place a licensee on probation for the period and subject to conditions specified by the commissioner;\n(d) impose an administrative penalty in an amount not to exceed $2,500 for each violation; or\n(e) issue a cease and desist order.","path":["Title 31A Insurance Code","Chapter 31A-40 Professional Employer Organization Licensing Act","Part 31A-40-4 Enforcement"],"source_url":"https://le.utah.gov/xcode/Title31A/Chapter40/31A-40-S402.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"5b5dbebf775e30e1b8ef6f55620c7624a02957008593a6a7a04393ccc73826c5","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-31a-40-401","next":"us-ut/utah-code-31a-41-101"},"notice":"GroundRules: Original legal text.
