{"data":{"id":"us-ut/utah-code-31a-8a-103","jurisdiction":"us-ut","citation":"Utah Code § 31A-8a-103","heading":"Scope and purposes.","body":"(1) A person shall comply with the provisions of this chapter if the person operates a health discount program in this state.\n(2) Notwithstanding any provision in this title, a person who only operates or markets a health discount program is exempt from:\n(a) Section 31A-4-113;\n(b) Section 31A-4-113.5;\n(c) Chapter 6a, Service Contracts;\n(d) Chapter 7, Nonprofit Health Service Insurance Corporations;\n(e) Section 31A-8-209;\n(f) Section 31A-8-211;\n(g) Section 31A-8-214;\n(h) Chapter 9, Insurance Fraternals, Chapter 10, Annuities, Chapter 11, Motor Clubs, and Chapter 12, State Risk Management Fund;\n(i) Chapter 17, Determination of Financial Condition, and Chapter 18, Investments;\n(j) Chapter 19a, Utah Rate Regulation Act;\n(k) Sections 31A-23a-103 and 31A-23a-104;\n(l) Chapter 25, Third Party Administrators, and Chapter 26, Insurance Adjusters;\n(m) Chapter 28, Guaranty Associations; and\n(n) Chapter 35, Bail Bond Act, Chapter 36, Life Settlements Act, Chapter 37, Captive Insurance Companies Act, and Chapter 38, Federal Health Care Tax Credit Program Act.\n(3) A person licensed under this title as an accident and health insurer or health maintenance organization:\n(a) is not required to obtain a license as required by Section 31A-8a-201 to operate a health discount program; and\n(b) is required to comply with all other provisions of this chapter.\n(4) The purposes of this chapter include:\n(a) full disclosure in the sale of health discount programs;\n(b) reasonable regulation of the marketing and disclosure practices of health discount program operators; and\n(c) licensing standards for health discount programs.\n(5) Nothing in this chapter prohibits a health discount program operator from marketing a health discount program operator's own services without a health discount program marketer license.","path":["Title 31A Insurance Code","Chapter 31A-8a Health Discount Program Consumer Protection Act","Part 31A-8a-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title31A/Chapter8a/31A-8a-S103.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"922dc6c77d09bed0be1c5f84a9597985196c910876b2000ce3fb8090b33604cd","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-31a-8a-102","next":"us-ut/utah-code-31a-8a-201"},"notice":"GroundRules: Original legal text.
