{"data":{"id":"us-ut/utah-code-31a-8a-201","jurisdiction":"us-ut","citation":"Utah Code § 31A-8a-201","heading":"License required.","body":"(1) Except as provided in Subsection 31A-8a-103(3), prior to operating or marketing a health discount program, a person shall:\n(a) be authorized to transact business in this state; and\n(b) be licensed by the commissioner.\n(2)\n(a) An application for licensure under this chapter shall be filed with the commissioner on a form prescribed by the commissioner.\n(b) The application shall be sworn to by an officer or authorized representative of the health discount program and shall include:\n(i) articles of incorporation with bylaws or other enabling documents that establish the organizational structure;\n(ii) information required by the commissioner by administrative rule which the commissioner determines is necessary to:\n(A) identify and locate principals, operators, and marketers involved with the health discount program; and\n(B) protect the interests of enrollees of health discount programs, health care providers, and consumers;\n(iii) biographical information, and when requested by the commissioner, a criminal background check, under the provisions of Subsection 31A-23a-105(3);\n(iv) the disclosures required in Section 31A-8a-203; and\n(v) the fee established in accordance with Section 31A-3-103.","path":["Title 31A Insurance Code","Chapter 31A-8a Health Discount Program Consumer Protection Act","Part 31A-8a-2 Licensure"],"source_url":"https://le.utah.gov/xcode/Title31A/Chapter8a/31A-8a-S201.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"170144b39e9392ab5f803f1f4103ebdb611984f7816fb99c4f9ca7d4f0f8442e","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-31a-8a-103","next":"us-ut/utah-code-31a-8a-202"},"notice":"GroundRules: Original legal text.
