{"data":{"id":"us-ut/utah-code-32b-1-306","jurisdiction":"us-ut","citation":"Utah Code § 32B-1-306","heading":"Use of information from a criminal background check.","body":"The commission or department may use information obtained pursuant to Section 32B-1-305 only for one or more of the following purposes:\n(1) enforcing this title;\n(2) determining whether an individual is convicted of any of the following offenses that disqualify the individual under this title from acting in a capacity described in Subsection 32B-1-305(2):\n(a) within the previous seven years, a felony under federal law or state law;\n(b) within the previous four years:\n(i) a violation of a federal law, state law, or local ordinance concerning the sale, offer for sale, warehousing, manufacture, distribution, transportation, or adulteration of an alcoholic product; or\n(ii) a crime involving moral turpitude; or\n(c) on two or more occasions within the previous five years, driving under the influence of alcohol, drugs, or the combined influence of alcohol and drugs;\n(3) determining whether an individual fails to accurately disclose the individual's criminal history on an application or document filed with the department or commission;\n(4) approving or denying an application for employment with the department;\n(5) taking disciplinary action against a department employee, including possible termination of employment;\n(6) issuing or denying an application to operate a package agency;\n(7) issuing or denying an application for a license;\n(8) issuing or denying the renewal of a package agency agreement;\n(9) issuing or denying the renewal of a license;\n(10) suspending the operation of a package agency;\n(11) terminating a package agency contract; or\n(12) suspending or revoking a license.","path":["Title 32B Alcoholic Beverage Control Act","Chapter 32B-1 Alcoholic Beverage Control General Provisions","Part 32B-1-3 Qualifications and Background"],"source_url":"https://le.utah.gov/xcode/Title32B/Chapter1/32B-1-S306.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"d97e0b105ee86e8af45953a3984106349c6fe1f94780571d03cd4b5620fe6d6e","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-32b-1-305","next":"us-ut/utah-code-32b-1-307"},"notice":"GroundRules: Original legal text.
