{"data":{"id":"us-ut/utah-code-32b-10-204","jurisdiction":"us-ut","citation":"Utah Code § 32B-10-204","heading":"Duties of commission and department before issuing special use permit.","body":"(1)\n(a) Before the commission issues a special use permit, the department shall conduct an investigation and may hold public hearings to gather information and make recommendations to the commission as to whether a special use permit should be issued.\n(b) The department shall forward the information it gathers and its recommendations to the commission to aid in the commission's determination.\n(2) Before issuing a special use permit, the commission shall:\n(a) determine that the person filed a complete application and is in compliance with:\n(i) Section 32B-10-202; and\n(ii) the relevant part under this chapter that applies to the special use permit for which the person is applying;\n(b) determine that the person is not disqualified under Section 32B-1-304;\n(c) consider the physical characteristics of the premises where an alcoholic product is proposed to be used, mixed, stored, sold, offered for sale, or furnished such as:\n(i) the condition of the premises;\n(ii) public visibility; and\n(iii) safety considerations;\n(d) consider the person's ability to properly use the special use permit within the requirements of this title and the commission rules including:\n(i) the proposed use of the special use permit; and\n(ii) the nature and type of person making use of the special use permit;\n(e) consider specific factors regarding the specific type of special use permit sought by the person;\n(f) approve of the location and equipment used by the person to distill alcohol for experimental testing purposes or use as a fuel; and\n(g) consider any other factor the commission considers necessary.","path":["Title 32B Alcoholic Beverage Control Act","Chapter 32B-10 Special Use Permit Act","Part 32B-10-2 Special Use Permitting General Provisions"],"source_url":"https://le.utah.gov/xcode/Title32B/Chapter10/32B-10-S204.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"f64865ffb83d927343b61aef0b44bdb809b1a42531fb5db9410e29a229550894","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-32b-10-203","next":"us-ut/utah-code-32b-10-205"},"notice":"GroundRules: Original legal text.
