{"data":{"id":"us-ut/utah-code-32b-11-206","jurisdiction":"us-ut","citation":"Utah Code § 32B-11-206","heading":"Duties of commission and department before issuing manufacturing license.","body":"(1)\n(a) Before the commission may issue a manufacturing license, the department shall conduct an investigation and may hold public hearings to gather information and make recommendations to the commission as to whether a manufacturing license should be issued.\n(b) The department shall forward to the commission the information and recommendations under Subsection (1)(a) to aid in the commission's determination.\n(2) Before issuing a manufacturing license, the commission shall:\n(a) determine that the person filed a complete application and is in compliance with:\n(i) Sections 32B-11-203 and 32B-11-205; and\n(ii) the relevant part under this chapter for the specific type of manufacturing license;\n(b) determine that the person is not disqualified under Section 32B-1-304;\n(c) consider the physical characteristics of the premises where an alcoholic product is proposed to be stored, mixed, or manufactured such as:\n(i) condition of the premises; and\n(ii) safety and security considerations;\n(d) consider the person's ability to properly use the manufacturing license within the requirements of this title and the commission rules including:\n(i) manufacturing capacity;\n(ii) extent of product distribution; and\n(iii) the nature and type of entity making use of the manufacturing license;\n(e) consider any special factor as provided in this chapter that may be unique to the specific type of manufacturing license sought by the person;\n(f) approve of the location and equipment used by the person to manufacture an alcoholic product; and\n(g) consider any other factor the commission considers necessary.","path":["Title 32B Alcoholic Beverage Control Act","Chapter 32B-11 Manufacturing and Related Licenses Act","Part 32B-11-2 Manufacturing Licensing General Provisions"],"source_url":"https://le.utah.gov/xcode/Title32B/Chapter11/32B-11-S206.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"5b9cb1edd25706177f73704bc5c07b6cdcbbe39ccad9037600cd1fe462e26c2a","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-32b-11-205","next":"us-ut/utah-code-32b-11-207"},"notice":"GroundRules: Original legal text.
