{"data":{"id":"us-ut/utah-code-32b-12-205","jurisdiction":"us-ut","citation":"Utah Code § 32B-12-205","heading":"Duties of commission and department before issuing liquor warehousing license.","body":"(1)\n(a) Before the commission may issue a warehousing license or approve a change of location for a licensee's warehouse facility, the department shall conduct an investigation and may hold public hearings to gather information and make recommendations to the commission as to whether a liquor warehousing license should be issued or a change of location granted.\n(b) The department shall forward the information and recommendations described in Subsection (1)(a) to the commission to aid in the commission's determination.\n(2) Before issuing a liquor warehousing license, the commission shall:\n(a) determine that the person filed a complete application and has complied with Sections 32B-12-202 and 32B-12-204;\n(b) determine that the person is not disqualified under Section 32B-1-304;\n(c) consider the physical characteristics of the premises where the person proposes to warehouse liquor, including:\n(i) location;\n(ii) proximity to transportation; and\n(iii) condition, size, and security of the licensed premises;\n(d) consider the person's ability to properly use the liquor warehousing license within the requirements of this title and the commission rules including:\n(i) the types of products other than liquor that the person is warehousing;\n(ii) the brands of liquor the person intends to warehouse; and\n(iii) the means the person intends to use to distribute the liquor; and\n(e) consider any other factor the commission considers necessary.\n(3) Before approving a liquor warehousing licensee's request to change the location of the licensee's warehouse facility, the commission shall:\n(a) determine that the licensee filed a complete change of location application;\n(b) consider the physical characteristics of the premises where the licensee proposes to warehouse liquor, including:\n(i) location;\n(ii) proximity to transportation; and\n(iii) condition, size, and security of the licensed premises; and\n(c) consider any other factor the commission considers necessary.","path":["Title 32B Alcoholic Beverage Control Act","Chapter 32B-12 Liquor Warehousing License Act","Part 32B-12-2 Liquor Warehousing License Process"],"source_url":"https://le.utah.gov/xcode/Title32B/Chapter12/32B-12-S205.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"3777b348ba3cc1728b2033bc23703d618599dc20d08e582c31e900cda27193aa","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-32b-12-204","next":"us-ut/utah-code-32b-12-206"},"notice":"GroundRules: Original legal text.
