{"data":{"id":"us-ut/utah-code-32b-13-205","jurisdiction":"us-ut","citation":"Utah Code § 32B-13-205","heading":"Commission and department duties before issuing beer wholesaling license.","body":"(1)\n(a) Before the commission may issue a beer wholesaling license, the department shall conduct an investigation and may hold public hearings to gather information and make recommendations to the commission as to whether a beer wholesaling license should be issued.\n(b) The department shall forward the information and recommendations described in Subsection (1)(a) to the commission to aid in the commission's determination.\n(2) Before issuing a beer wholesaling license, the commission shall:\n(a) determine that the person filed a complete application and is in compliance with Sections 32B-13-202 and 32B-13-204;\n(b) determine that the person is not disqualified under Section 32B-1-304;\n(c) consider the physical characteristics of the licensed premises where it is proposed that beer be stored by the person, such as:\n(i) location;\n(ii) proximity to transportation; and\n(iii) condition, size, and security of the licensed premises;\n(d) consider the person's ability to manage and operate a beer wholesaling operation, including:\n(i) management experience;\n(ii) past wholesaling experience;\n(iii) the brands the person intends to wholesale; and\n(iv) the means the person intends to use to distribute beer; and\n(e) consider any other factor that the commission considers necessary.","path":["Title 32B Alcoholic Beverage Control Act","Chapter 32B-13 Beer Wholesaling License Act","Part 32B-13-2 Beer Wholesaling License Process"],"source_url":"https://le.utah.gov/xcode/Title32B/Chapter13/32B-13-S205.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"ac774217f0b3f1089be30974d28b901110bffc3b7e8648d24e0ae83b3b7fea36","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-32b-13-204","next":"us-ut/utah-code-32b-13-206"},"notice":"GroundRules: Original legal text.
