{"data":{"id":"us-ut/utah-code-32b-14-303","jurisdiction":"us-ut","citation":"Utah Code § 32B-14-303","heading":"Prohibited conduct of wholesaler.","body":"(1) A wholesaler may not:\n(a) induce or coerce, or attempt to induce or coerce, a retailer to engage in an illegal act or course of conduct;\n(b) impose a requirement that is discriminatory by its terms or in the methods of enforcement as compared to requirements imposed by the wholesaler on similarly situated retailers;\n(c) prohibit a retailer from selling a product of another wholesaler;\n(d) fix or maintain the price at which a retailer may resell beer;\n(e) require a retailer to accept delivery of beer or any other item that is not voluntarily ordered by the retailer;\n(f) restrict or inhibit, directly or indirectly, the right of a retailer to participate in an organization representing interests of retailers for a lawful purpose;\n(g) require a retailer to participate in or contribute to a local, regional, or national advertising fund or other promotional activity;\n(h) retaliate against a retailer that files a complaint with the department or the applicable federal agency regarding an alleged violation by the wholesaler of a state or federal statute or administrative rule; and\n(i) refuse to deliver a beer product carried by the wholesaler to a properly licensed retailer who resides within the wholesaler's sales territory:\n(i) in a reasonable quantity; and\n(ii) within a reasonable time after receipt of the retailer's order.\n(2) Notwithstanding Subsection (1)(i), the wholesaler may refuse to deliver a beer product if the refusal is due to:\n(a) the retailer's failure to pay the wholesaler pursuant to Subsection 32B-4-704(6);\n(b) an unforeseeable event beyond the wholesaler's control;\n(c) a work stoppage or delay due to a strike or labor problem;\n(d) a bona fide shortage of materials; or\n(e) a freight embargo.","path":["Title 32B Alcoholic Beverage Control Act","Chapter 32B-14 Utah Beer Industry Distribution Act","Part 32B-14-3 Operational Provisions"],"source_url":"https://le.utah.gov/xcode/Title32B/Chapter14/32B-14-S303.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"fbf4dbac7b246bf8fe18f8031f96cf3d5b4d33e8d6bd2f41f265479ed3fff64c","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-32b-14-302","next":"us-ut/utah-code-32b-14-304"},"notice":"GroundRules: Original legal text.
