{"data":{"id":"us-ut/utah-code-32b-2-802","jurisdiction":"us-ut","citation":"Utah Code § 32B-2-802","heading":"Consumer purchasing system.","body":"(1) The division shall establish and administer a consumer purchasing system that:\n(a) allows a person to:\n(i) order an alcoholic product from an approved vendor through the division; and\n(ii) pick up an alcoholic product ordered as described in Subsection (1)(a)(i) from a state store or package agency; and\n(b) requires a person ordering an alcoholic product as described in Subsection (1)(a) to, at the time the order is made:\n(i) designate a state store or package agency at which the person would prefer to collect the alcoholic product; and\n(ii) pay the division for the alcoholic product order in full, including:\n(A) the cost of the alcoholic product; and\n(B) in addition to any tax, the markup described in Section 32B-2-304.\n(2) The division shall:\n(a) ensure that an alcoholic product ordered through the consumer purchasing system is shipped or transported to a department warehouse;\n(b) deliver an alcoholic product ordered through the consumer purchasing system to the appropriate state store or package agency;\n(c) notify the person who ordered an alcoholic product through the consumer purchasing system when the alcoholic product is ready for the person to collect; and\n(d) administer the consumer purchasing system in a manner that:\n(i) is efficient;\n(ii) ensures timely delivery of alcoholic products; and\n(iii) frequently updates a person who orders an alcoholic product through the consumer purchasing system on the status of the order.\n(3) The division may not require that a person order a specific quantity of an alcoholic product that is:\n(a) different than a quantity the vendor offers for sale; or\n(b) larger than the smallest quantity the vendor offers for sale.","path":["Title 32B Alcoholic Beverage Control Act","Chapter 32B-2 Alcoholic Beverage Services Administration Act","Part 32B-2-8 Consumer Purchasing System"],"source_url":"https://le.utah.gov/xcode/Title32B/Chapter2/32B-2-S802.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"f6e72923ffa3388c1243e8196035980ee1aafd8fac7b01d36c0a7f766b6915d5","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-32b-2-801","next":"us-ut/utah-code-32b-2-803"},"notice":"GroundRules: Original legal text.
