{"data":{"id":"us-ut/utah-code-32b-3-102","jurisdiction":"us-ut","citation":"Utah Code § 32B-3-102","heading":"Definitions.","body":"As used in this chapter:\n(1) \"Aggravating circumstances\" means:\n(a) prior warnings about compliance problems;\n(b) a prior violation history;\n(c) a lack of written policies governing employee conduct;\n(d) multiple violations during the course of an investigation;\n(e) efforts to conceal a violation;\n(f) an intentional violation;\n(g) the violation involved more than one patron or employee; or\n(h) a violation that results in injury or death.\n(2) \"Final adjudication\" means an adjudication for which a final judgment or order is issued that:\n(a) is not appealed, and the time to appeal the judgment has expired; or\n(b) is appealed, and is affirmed, in whole or in part, on appeal.\n(3) \"Mitigating circumstances\" means:\n(a) no prior violation history for the licensee or permittee;\n(b) no prior violation history for the individual who committed the violation;\n(c) motive for the individual who engaged in or allowed the violation to retaliate against the licensee or permittee; or\n(d) extraordinary cooperation with the investigation of the violation that demonstrates that the licensee or permittee and the individual who committed the violation accept responsibility for the violation.","path":["Title 32B Alcoholic Beverage Control Act","Chapter 32B-3 Disciplinary Actions and Enforcement Act","Part 32B-3-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title32B/Chapter3/32B-3-S102.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"1e6efdd4537b912fa8962733e6679152bd91e33c61d4cb0fd562a4ad772de5a2","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-32b-3-101","next":"us-ut/utah-code-32b-3-201"},"notice":"GroundRules: Original legal text.
