{"data":{"id":"us-ut/utah-code-32b-4-403","jurisdiction":"us-ut","citation":"Utah Code § 32B-4-403","heading":"Unlawful sale, offer for sale, or furnishing to minor.","body":"(1) A person may not sell, offer for sale, or furnish an alcoholic product to a minor.\n(2)\n(a)\n(i) Except as provided in Subsection (3), a person is guilty of a class B misdemeanor if the person who violates Subsection (1) negligently or recklessly fails to determine whether the recipient of the alcoholic product is a minor.\n(ii) As used in this Subsection (2)(a), \"negligently\" means with simple negligence.\n(b) Except as provided in Subsection (3), a person is guilty of a class A misdemeanor if the person who violates Subsection (1) knows the recipient of the alcoholic product is a minor.\n(3) This section does not apply to the furnishing of an alcoholic product to a minor in accordance with this title:\n(a) for medicinal purposes by:\n(i) the parent or guardian of the minor; or\n(ii) the health care practitioner of the minor, if the health care practitioner is authorized by law to write a prescription; or\n(b) as part of a religious organization's religious services.","path":["Title 32B Alcoholic Beverage Control Act","Chapter 32B-4 Criminal Offenses and Procedure Act","Part 32B-4-4 Sale, Purchase, Possession, and Consumption"],"source_url":"https://le.utah.gov/xcode/Title32B/Chapter4/32B-4-S403.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"6c2a67093371f8e2d9222b954ffcd4d66206e4d6e1700f92d9e929bf10a1e698","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-32b-4-402","next":"us-ut/utah-code-32b-4-404"},"notice":"GroundRules: Original legal text.
