{"data":{"id":"us-ut/utah-code-32b-4-423","jurisdiction":"us-ut","citation":"Utah Code § 32B-4-423","heading":"Immunity regarding alcohol consumption offenses when seeking emergency aid for another person.","body":"(1) A law enforcement officer may not cite or arrest a person solely because of a person's violation of a provision under Subsection (2) if the officer came into contact with the person because:\n(a) the person had requested or acted in concert with another person to request emergency medical assistance for a third party who reasonably appeared to be in need of medical care due to the consumption of alcohol;\n(b) the officer was responding to the request for emergency medical assistance;\n(c) the person provided to the officer the person's name and identifying information as requested by the officer;\n(d) the person remained at the location where the third party was located until emergency medical response personnel arrived at the location; and\n(e) the person cooperated with the emergency medical assistance personnel and law enforcement officers at the location.\n(2) Offenses referred to in Subsection (1) are violations of:\n(a) Section 32B-4-403 regarding the unlawful sale, offer for sale, or furnishing of alcohol to a minor;\n(b) Subsection 32B-4-409(1) regarding the unlawful purchase, possession, or consumption of alcohol by a minor; and\n(c) Subsection 76-9-110(2) regarding intoxication when the offense involves consumption of alcohol.\n(3) An officer who declines to cite or arrest a person while acting in good faith under Subsection (1) is not civilly liable.","path":["Title 32B Alcoholic Beverage Control Act","Chapter 32B-4 Criminal Offenses and Procedure Act","Part 32B-4-4 Sale, Purchase, Possession, and Consumption"],"source_url":"https://le.utah.gov/xcode/Title32B/Chapter4/32B-4-S423.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"28385d8569b6175df9bd9e348301ea1aee8e4e20f5c36fc4243f7e99cc586d26","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-32b-4-422","next":"us-ut/utah-code-32b-4-424"},"notice":"GroundRules: Original legal text.
