{"data":{"id":"us-ut/utah-code-32b-4-702","jurisdiction":"us-ut","citation":"Utah Code § 32B-4-702","heading":"Definitions.","body":"As used in this part:\n(1)\n(a) For purposes of Section 32B-4-703, \"exclusion\" is as defined in 27 C.F.R. Sec. 8.51 through 8.54.\n(b) For purposes of Section 32B-4-704, \"exclusion\" is as defined in 27 C.F.R. Sec. 6.151 through 6.153.\n(2)\n(a) \"Industry member\" means:\n(i) an alcoholic product manufacturer;\n(ii) a producer;\n(iii) a supplier;\n(iv) an importer;\n(v) a wholesaler;\n(vi) a bottler;\n(vii) a warehouser and bottler; or\n(viii) for a person described in Subsections (2)(a)(i) through (vii), any of its:\n(A) affiliates;\n(B) subsidiaries;\n(C) officers;\n(D) directors;\n(E) partners;\n(F) agents;\n(G) employees; or\n(H) representatives.\n(b) \"Industry member\" does not include:\n(i) the commission;\n(ii) a commissioner;\n(iii) the director;\n(iv) the department; or\n(v) a department employee.\n(3) \"Product\" means an alcoholic product or item associated with an alcoholic product.\n(4) \"Retailer\" means:\n(a) the holder of a license or permit issued by the commission or by a local authority to allow the holder to engage in the sale of an alcoholic product to a patron whether for consumption on or off the premises; or\n(b) an agent, officer, director, shareholder, partner, or employee of a holder described in Subsection (4)(a).","path":["Title 32B Alcoholic Beverage Control Act","Chapter 32B-4 Criminal Offenses and Procedure Act","Part 32B-4-7 Trade Practices Act"],"source_url":"https://le.utah.gov/xcode/Title32B/Chapter4/32B-4-S702.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"6cc78cb27e30a27493df45cb1d9315b74e37ff0f8cdfde7c810bfba260a208a5","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-32b-4-701","next":"us-ut/utah-code-32b-4-703"},"notice":"GroundRules: Original legal text.
