{"data":{"id":"us-ut/utah-code-32b-5-305","jurisdiction":"us-ut","citation":"Utah Code § 32B-5-305","heading":"Pricing of alcoholic product -- Other charge.","body":"(1) Except as provided in Section 32B-2-213, a retail licensee:\n(a) may sell, offer for sale, or furnish liquor only at a price fixed by the commission; and\n(b) may not sell an alcoholic product at a discount price on any date or at any time.\n(2)\n(a) A retail licensee may not sell, offer for sale, or furnish an alcoholic product at less than the cost of the alcoholic product to the retail licensee.\n(b) A retail licensee may not sell, offer for sale, or furnish an alcoholic product at a special or reduced price that encourages overconsumption or intoxication.\n(c) A retail licensee may not sell, offer for sale, or furnish an alcoholic product at a special or reduced price for only certain hours of the retail licensee's business day, such as a \"happy hour.\"\n(d) A retail licensee may not sell, offer for sale, or furnish more than one alcoholic product for the price of a single alcoholic product.\n(e) A retail licensee may not sell, offer for sale, or furnish an indefinite or unlimited number of alcoholic products during a set period for a fixed price.\n(f) A retail licensee may not engage in a promotion involving or offering a free alcoholic product to the general public.\n(3) As authorized by commission rule, a retail licensee may charge a patron for providing:\n(a) a service related to liquor purchased at the licensed premises; or\n(b) wine service performed for wine carried in by a patron in accordance with Section 32B-5-307.","path":["Title 32B Alcoholic Beverage Control Act","Chapter 32B-5 Retail License Act","Part 32B-5-3 Retail Licensee Operational Requirements"],"source_url":"https://le.utah.gov/xcode/Title32B/Chapter5/32B-5-S305.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"ba42f389f4aedbaadf3e365dad9adf5c2d32a16b032fc9ec9a7cf4cb26badde4","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-32b-5-304","next":"us-ut/utah-code-32b-5-306"},"notice":"GroundRules: Original legal text.
