{"data":{"id":"us-ut/utah-code-32b-5-308","jurisdiction":"us-ut","citation":"Utah Code § 32B-5-308","heading":"Requirements on staff or others on premises -- Employing a minor.","body":"(1) As used in this section, \"straw test\" means a technique used by staff of a retail licensee to taste liquor to ensure the quality, flavor, and alcohol content of the liquor by:\n(a) dipping the straw into the liquor;\n(b) removing the straw in a manner that a small amount of liquor remains in the straw; and\n(c) tasting the small amount of liquor from the straw.\n(2) Except as provided in Subsection (5), staff of a retail licensee, while on duty, may not:\n(a) consume an alcoholic product; or\n(b) be intoxicated.\n(3)\n(a) A retail licensee may not employ a minor to sell, offer for sale, furnish, or dispense an alcoholic product.\n(b) Notwithstanding Subsection (3)(a), unless otherwise prohibited in the provisions related to the specific type of retail license, a retail licensee may employ a minor who is at least 16 years old to enter the sale at a cash register or other sales recording device.\n(4) A full-service restaurant licensee, limited-service restaurant licensee, or beer-only restaurant licensee may employ a minor who is at least 16 years old to bus tables, including containers that contain an alcoholic product.\n(5) A staff member of a retail licensee may conduct a straw test if the staff member is not a minor.","path":["Title 32B Alcoholic Beverage Control Act","Chapter 32B-5 Retail License Act","Part 32B-5-3 Retail Licensee Operational Requirements"],"source_url":"https://le.utah.gov/xcode/Title32B/Chapter5/32B-5-S308.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"ed9edba174a788d7a83812ffcdc8727518d0870a37734a8f191dc76145b53e43","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-32b-5-307","next":"us-ut/utah-code-32b-5-309"},"notice":"GroundRules: Original legal text.
