{"data":{"id":"us-ut/utah-code-34-38-13","jurisdiction":"us-ut","citation":"Utah Code § 34-38-13","heading":"Confidentiality of test-related information.","body":"(1) For purposes of this section, \"test-related information\" means the following received by the employer through the employer's drug or alcohol testing program:\n(a) information;\n(b) interviews;\n(c) reports;\n(d) statements;\n(e) memoranda; or\n(f) test results.\n(2) Except as provided in Subsections (3) and (6), test-related information is a confidential communication and may not be:\n(a) used or received in evidence;\n(b) obtained in discovery; or\n(c) disclosed in any public or private proceeding.\n(3) Test-related information:\n(a) shall be disclosed to the Division of Professional Licensing:\n(i) in the manner provided in Subsection 58-13-5(3); and\n(ii) only to the extent required under Subsection 58-13-5(3); and\n(b) may only be used in a proceeding related to:\n(i) an action taken by the Division of Professional Licensing under Section 58-1-401 when the Division of Professional Licensing is taking action in whole or in part on the basis of test-related information disclosed under Subsection (3)(a);\n(ii) an action taken by an employer under Section 34-38-8; or\n(iii) an action under Section 34-38-11.\n(4) Test-related information shall be the property of the employer.\n(5) An employer is entitled to use a drug or alcohol test result as a basis for action under Section 34-38-8.\n(6) An employer may not be examined as a witness with regard to test-related information, except:\n(a) in a proceeding related to an action taken by the employer under Section 34-38-8;\n(b) in an action under Section 34-38-11; or\n(c) in an action described in Subsection (3)(b)(i).","path":["Title 34 Labor in General","Chapter 34-38 Drug and Alcohol Testing"],"source_url":"https://le.utah.gov/xcode/Title34/Chapter38/34-38-S13.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"3c1dc24df7208d1409956c443b526894f35a02a8cf9fedb4c86685a3ddfc19b2","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-34-38-12","next":"us-ut/utah-code-34-38-14"},"notice":"GroundRules: Original legal text.
