{"data":{"id":"us-ut/utah-code-34-40-204","jurisdiction":"us-ut","citation":"Utah Code § 34-40-204","heading":"Criminal penalty -- Enforcement.","body":"(1) As used in this section, \"violation\" includes separate violations as to individual employees arising out of the same investigation or enforcement action.\n(2)\n(a) A violation of this chapter is an infraction.\n(b) A second violation of this chapter is a class C misdemeanor.\n(c) A third or subsequent violation of this chapter is a class B misdemeanor.\n(3) Upon an employer's violation of this section, the commission may prosecute a criminal action in the name of the state.\n(4) The county attorney, district attorney, or attorney general shall provide assistance in prosecutions under this section at the request of the commission.","path":["Title 34 Labor in General","Chapter 34-40 Utah Minimum Wage Act","Part 34-40-2 Enforcement - Penalties"],"source_url":"https://le.utah.gov/xcode/Title34/Chapter40/34-40-S204.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"50a5fa772f3716ee2033a7a090fb203e16ab85f7b75256bd81dcd00c9da844e5","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-34-40-203","next":"us-ut/utah-code-34-40-205"},"notice":"GroundRules: Original legal text.
