{"data":{"id":"us-ut/utah-code-34-46-202","jurisdiction":"us-ut","citation":"Utah Code § 34-46-202","heading":"Use of information collected in initial selection process.","body":"(1)\n(a) An employer may not:\n(i) use information about an applicant obtained through an initial selection process for a purpose other than to determine whether or not the employer will hire the applicant as an employee; or\n(ii) except as provided in Subsection (2), provide information about an applicant obtained through an initial selection process to a person other than the employer.\n(b) A use prohibited under this Subsection (1) includes:\n(i) marketing;\n(ii) profiling;\n(iii) reselling of the information; or\n(iv) a similar use.\n(2) Notwithstanding the other provisions of this section, an employer may provide information:\n(a) as required by law;\n(b) to a government entity for the purpose of:\n(i) determining eligibility for a government service, benefit, or program; or\n(ii) participating in a government service, benefit, or program;\n(c) if the applicant applies for another position with the employer; or\n(d) if the applicant becomes an employee and the information is used for one or more of the following, that is also applied to other employees in a similar position:\n(i) a performance review; or\n(ii) a promotion application.","path":["Title 34 Labor in General","Chapter 34-46 Employment Selection Procedures Act","Part 34-46-2 Requirements Related to Information"],"source_url":"https://le.utah.gov/xcode/Title34/Chapter46/34-46-S202.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"0faa90a5932b7d233402435f5c0a16da57b6e39b402b706003aa81ee11371557","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-34-46-201","next":"us-ut/utah-code-34-46-203"},"notice":"GroundRules: Original legal text.
