{"data":{"id":"us-ut/utah-code-34-53a-201","jurisdiction":"us-ut","citation":"Utah Code § 34-53a-201","heading":"Conditions under which a remote-service contractor is not an employee of a marketplace company.","body":"(1) A remote-service contractor is not an employee of a marketplace company, if under the agreement between the remote-service contractor and the marketplace company and in fact:\n(a) all or substantially all of the work the remote-service contractor performs under the agreement:\n(i) is on a per-job or per-transaction basis; and\n(ii) the remote-service contractor receives payment for on an hourly, per-job, or per-transaction basis;\n(b) the marketplace company does not:\n(i) prescribe specific hours during which the remote-service contractor must be available to accept a request for remote service;\n(ii) prescribe a specific location where the remote-service contractor must be available to perform a remote service; or\n(iii) restrict the remote-service contractor from engaging in another occupation or business; and\n(c) except for the use of the marketplace company's digital application, the remote-service contractor is responsible for providing the necessary tools, materials, and equipment to perform a remote service a person requests through the marketplace company's digital application.\n(2) A marketplace company's act of screening or training a remote-service contractor does not affect the remote-service contractor's employment status under this chapter.","path":["Title 34 Labor in General","Chapter 34-53a Remote Service Marketplace Platforms Act","Part 34-53a-2 Employment Status"],"source_url":"https://le.utah.gov/xcode/Title34/Chapter53a/34-53a-S201.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"f511e56ce10e46c50f8109558379cfae369aa682ed8d1cf9a1a7526d0862c423","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-34-53a-102","next":"us-ut/utah-code-34-54-101"},"notice":"GroundRules: Original legal text.
