{"data":{"id":"us-ut/utah-code-34-57-102","jurisdiction":"us-ut","citation":"Utah Code § 34-57-102","heading":"Administration -- Assignment of benefits -- Portability.","body":"(1) A governmental entity or private entity may offer a portable benefit plan.\n(2) Contributions to a portable benefit plan:\n(a) shall be voluntary; and\n(b) may not be used as a criterion for determining a person's employment classification.\n(3) If an Internet or application-based company contributes to a portable benefit plan for the benefit of an individual beneficiary:\n(a) the contribution is not evidence of employer liability; and\n(b) a court may not construe the contribution as an element of an employment relationship for purposes of:\n(i) Title 34A, Chapter 2, Workers' Compensation Act; or\n(ii) Title 35A, Chapter 4, Employment Security Act.","path":["Title 34 Labor in General","Chapter 34-57 Portable Benefit Plan","Part 34-57-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title34/Chapter57/34-57-S102.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"95f4cfed3794bed1ed958cb0ba14b561945cad736f1cb4e173301df72b8c2fcc","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-34-57-101","next":"us-ut/utah-code-34a-1-101"},"notice":"GroundRules: Original legal text.
